As of: July 2026
English version for convenience — in case of any discrepancy, the German T&Cs apply, and German law governs.
Property: Krekeler Str. 16, 53925 Kall-Rüth
Operator: GG Breuer & Fischenich, Rennbahnstr. 24, 50737 Köln
1. Scope and contracting parties
These General Terms and Conditions (“GTC”) apply to all bookings of the holiday home “Colina Kall”, Krekeler Str. 16, 53925 Kall-Rüth, marketed under the brand “relax.casa”.
The contracting party and landlord (operator) is GG Breuer & Fischenich (Grundstücksgemeinschaft), Rennbahnstr. 24, 50737 Köln, hereinafter “Landlord”. “relax.casa” is the brand under which the Landlord operates; “Colina Kall” refers to the specific rental property. The contracting party on the guest side is the person making the booking (“Guest”), even if additional persons are travelling with them.
For bookings made via third-party platforms (e.g. Airbnb, Booking.com), the respective platform’s booking and cancellation terms apply in addition. In case of conflict between platform terms and these GTC, the platform terms prevail for payment processing and cancellation; these GTC apply otherwise.
2. Conclusion of contract
The accommodation contract is concluded upon the Landlord’s booking confirmation (by email or via the respective booking platform).
The booking is made for the specified number of guests, maximum 4 persons. Exceeding the occupancy without the Landlord’s prior consent entitles the Landlord to terminate the contract with immediate effect.
A minimum stay of 2 nights applies.
The Landlord is entitled to inspect a valid ID card or passport of the Guest and accompanying persons, or to record their data, for identification purposes and to fulfil statutory registration obligations.
3. Prices and payment
The prices displayed at the time of booking on the respective platform or in the Landlord’s offer apply. These include statutory VAT.
Payment terms (deposit, due date, payment method) follow the terms of the respective booking platform or a separate agreement in case of direct booking.
No security deposit is charged. The Guest remains liable for damage caused by themselves or accompanying persons in accordance with clause 10.
4. Cancellation and withdrawal
For bookings made via a third-party platform, only the cancellation terms published on that platform at the time of booking apply.
For direct bookings with the Landlord, unless otherwise agreed in writing: cancellation up to 14 days before arrival is free of charge; thereafter the full price is due unless the period can be re-let.
A no-show without prior cancellation is treated as withdrawal on the arrival date with corresponding cost consequences.
5. Check-in / check-out
Check-in: from 4:00 p.m. · Check-out: by 11:00 a.m.
Access is via a key box; access details are sent to the Guest before arrival by WhatsApp, SMS or email. Deviating check-in/check-out times are only possible by prior arrangement.
6. Use of the property
The property may only be used for residential purposes by the Guest and the persons specified in the booking. Subletting or transfer of use to third parties is excluded.
This holiday home is intended for rest and relaxation. Events and parties of any kind are not permitted.
The Landlord’s House Rules, provided to the Guest before or upon arrival, apply and form part of this contract.
Use of the sauna and whirlpool is at the Guest’s own risk; the safety and operating instructions provided on site must be observed.
7. Landlord’s right of access
The Landlord or persons commissioned by the Landlord are entitled to enter the property, following reasonable prior notice, to inspect for damage or defects, carry out necessary repairs, or read meters.
In the event of imminent danger (e.g. water damage, fire), the Landlord may enter the property without prior notice and in the Guest’s absence in order to avert the danger.
8. Maintenance and structural measures
The Guest must tolerate repair work and structural changes necessary to preserve the property, avert imminent danger, or remedy damage, as well as modernisation measures in accordance with the applicable statutory provisions (§§ 555a et seq. BGB by analogy).
The Landlord is not liable for pre-existing defects of the property that existed at the time of contract conclusion without fault on the Landlord’s part.
9. Guest obligations
- Careful and considerate treatment of the property, its furnishings and technical equipment.
- Immediate notification of damage or defects to the Landlord via WhatsApp, SMS (+49 176 288 40 299) or email ( hallorelax.casa ).
- Compliance with applicable quiet hours and consideration for neighbours.
- No smoking inside the building.
10. Guest liability
The Guest is liable for damage to the property, furnishings or technical equipment (including sauna, whirlpool) culpably caused by themselves, accompanying persons or visitors.
The Guest is advised to hold private liability insurance.
11. Landlord liability
The Landlord is liable without limitation for damage resulting from injury to life, body or health, and for intent and gross negligence.
For other damage, the Landlord is only liable in the event of a breach of material contractual obligations, limited to the foreseeable, typical damage. Further liability is excluded.
The Landlord accepts no liability for valuables and personal property brought by guests, to the extent legally permissible.
12. End of contract and return of property
The Guest must return the property in a tidy, broom-clean condition at the end of the contract and return all rented furnishings and keys in full.
Continued use beyond the agreed end of the contract does not result in a tacit extension of the contractual relationship (deviating from § 545 BGB).
In the event of loss of keys or access devices provided, the Guest is obliged to reimburse the Landlord for the actual costs incurred for replacement keys or, if necessary, the replacement of locking systems.
13. Force majeure
If performance of the contractually owed service becomes impossible due to force majeure (e.g. natural events, official orders), both parties are entitled to withdraw from the contract; payments already made will be refunded on a pro-rata basis.
14. Data protection
Personal data collected in connection with the booking is processed exclusively for contract fulfilment and to meet statutory registration obligations. Details are set out in the separate privacy policy.
15. Final provisions
The law of the Federal Republic of Germany applies. Place of performance and, to the extent legally permissible, place of jurisdiction is the Landlord’s registered seat.
The Landlord is entitled to unilaterally amend these GTC to the extent necessary to adapt to changed legal or technical circumstances. Guests with existing bookings will be informed of material changes by email and may object in writing within four weeks; otherwise, the amended terms shall be deemed accepted.
Deviating terms and conditions of the Guest shall not apply unless the Landlord expressly agrees to their validity in writing.
Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
